Scope

This policy applies to websites operated or owned by Wilderness Hotel & Resort, Inc., including as applicable its affiliates, agents, licensees, or licensors (collectively, the “Wilderness”), as well as emails, texts, or other electronic messages sent by or on behalf of the Wilderness. The policy also applies to any third party, including but not limited to agents, vendors, suppliers, subcontractors, or independent contractors, with whom we may share information.

Personal information may include, but is not limited to, (i) information by which you may be personally identified, such as name, postal address, email address, telephone number, and any other identifier by which you may be contacted online or offline; (ii) information that is about you but individually does not identify you; and (iii) information about your internet connection, the equipment you use to access our websites or otherwise communicate with the Wilderness, and usage details.

Use of Personal Information:
The Wilderness is the sole owner of the information collected on www.wildernessresort.com or any other Wilderness website, or collected through emails. The Wilderness collects information from our users at several different points on our website, emails, texts and other communications through such technologies as cookies, log files, pixel tracking, and/or third parties, or through your interaction with any of the foregoing. We may use your personal information, either alone or in combination with other information, so that we can provide, enhance and personalize our service and our marketing efforts.  The following are examples of a variety of ways we may use your personal information:

  • To provide you with improved customer service.
  • To communicate with you regarding updates, offers, and promotions.
  • To help us develop, customize, deliver, support and improve our services, products, content and advertising.
  • To administer and distribute promotions.
  • To serve advertisements on our and other websites.
  • To enforce or protect the rights or property of applicable parties, and prevent fraud and other prohibited or illegal activities.
  • To protect the security of our products, services and business.
  • For our business purposes such as auditing, data analysis and research to improve our products, services and communications, or to work with our partners, affiliates, or third-party companies.

If you decide at any time that you no longer wish to receive email communications from us, please follow any unsubscribe instructions that may be provided in our emails to you.  Please note that we may use your personal information to contact you with notifications, promotions or offers.

The Wilderness may use third parties such as network advertisers to serve advertisements and may use traffic measurement services to analyze traffic.  Third party ad serving enables, for example, advertisements to be targeted to you for products and services in which you might be interested.  We may engage with third party companies and individuals to perform services on our behalf such as retargeting ads and promotions.

Use of Email Addresses:

The Wilderness will periodically send marketing and promotional information, or other messages, to emails obtained from online and telephone bookings as well as emails obtained from sweepstakes and contest entries.  As stated above, please follow any unsubscribe instructions provided in said marketing pieces if you do not wish to receive them.

Google Analytics:

The Wilderness websites and emails utilize Google Analytics Demographics and Interest Reporting, and may use similar or other third-party technologies in the future.  Learn more about how you can manage what information Google collects here.

SMS Text Communications:
By booking a reservation at the Wilderness, you are opting in to receive SMS text messages from us as a service to you.  These messages may contain information pertaining to your room being ready to check-in, inclement weather in the area, waterpark closures around the resort, or other information related to the Wilderness or your stay.  They are intended to aid in the communication with our guests and may help to make your stay as comfortable as possible. These SMS Text messages will generally stop upon or shortly following your departure.

Log Files, Pixel Tracking, and Other Technologies:
Like most website servers, we use log files. This includes Internet Protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp and number of clicks to analyze trends, administer the site, track user movement in the aggregate and gather broad demographic information for aggregate use.

Our websites and emails may also use technologies, including automatic data collection technologies, such as pixel tracking or web beacons. Accordingly, pages of our website and our emails may contain small electronic files (also referred to as clear gifs, pixel tags, or single-pixel gifs) that permit Wilderness or third parties to, for example, count users who have visited those pages or open emails and for other related statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

The above list of technologies is not intended to be exhaustive. We may use additional or alternative technologies in the future, whether similar to the foregoing or otherwise. 

Tracking Clicked Links:
In order to create a better electronic community, we track information such as patterns of use in the emails we send out. For example, we note which links are clicked in our email communications to tell us what areas are of most interest to our opt-in recipients. We may use this information to better personalize the content and promotions that we send you in future mailings. A “referrer” is the information passed along by a web browser that references the web URL you linked from and is automatically gathered by our web server. This information is used, for example, to identify broad demographic trends that may be used to provide information tailored to your interests.

Communications from the Site:
Members of or visitors to the site will occasionally receive newsletters, information on services or special deals. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see the Opt-Out Policy section. If a user wishes to subscribe to our newsletter, we generally ask for contact information such as name and email address, and possibly other information.

Security:
The Wilderness takes security safeguards it deems reasonable to protect against such risks as loss or unauthorized access, destruction, modification, or disclosure of personal information.

Legal Disclaimer:
We may need to disclose personal information if we have a good-faith belief that such action is necessary, such as to comply with applicable law or regulation, a current judicial proceeding, a court order, or legal process served on the Wilderness.

Opt-Out Policy:
The Wilderness will use email addresses and other personally identifiable information to contact visitors or other persons who communicate with us. For example, we email visitors who provide us with their email addresses for specific purposes such as receiving our email newsletters. After gathering any user information, the Wilderness may offer users the opportunity to remove their information from our database so as not to receive future communications or to no longer interact with the website until they later chose to. Email communications will generally contain instructions on how to discontinue receipt. If a visitor at any time chooses to no longer receive such information and opt-out from future mailings, they will generally have a reasonable opportunity to do so.

Notification of Changes:
If we decide to change our privacy policy, we will post those changes to this privacy policy on an applicable website so our users may become aware of what information we collect, how we use it and under what circumstances, if any, we disclose it. In some cases where we post a notice we will also email users who have opted to receive communications from us, notifying them of the changes in our privacy practices.

No Use by Children:

Our website is not intended for children under 16 years of age. No one under age 16 may provide any information to or on the website. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on this website or through any of its features, register on the website, make any purchases through the website, use any of the interactive or public comment features of this website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will take reasonable measures to delete that information. If you believe we might have any information from or about a child under 16, please contact us.

The Wilderness welcomes links to our site. All external links to wildernessresort.com or other applicable websites should be clearly identified. We believe strongly in the utility of hyperlinks, which allow you to point directly to content, whether on the same site or an external site. Please use the headline of the link to which you would like to connect from wildernessresort.com.

Nothing in this policy or the website, or any email, transfers, licenses, or otherwise alters any intellectual property right of the Wilderness. The names of actual companies and products mentioned on the website may be the trademarks of their respective owners. Any rights not expressly granted herein are reserved. 

Consent:

Any use of any Wilderness website or email is subject to this privacy policy, as the same may be updated from time to time. By accessing or using any applicable website or email, or by submitting information to us, you agree to our collection and use of your information as described in this privacy policy (or any update) and agree to be governed by these terms. These terms are in addition to, but are not limited by, any other terms agreed to by the parties or applicable to third-party products, services, or websites.
